Terms of Use

1. About these terms

Elbe Labs is a brand of Digitalis LLC ("we", "us"). These terms apply to the website elbelabs.com and to our games and apps, including Hydroform and Mechanical Keyboarding (together, the "Services"). By using the Services you agree to these terms and to our Privacy Policy. If you do not agree, please do not use them.

2. Using our games

We give you a personal, non-exclusive, non-transferable and revocable licence to use the Services for your own non-commercial entertainment and learning, in line with these terms. We may end this licence if you break these terms.

3. Store versions

If you get one of our games from Steam, the Epic Games Store, Google Play, the Apple App Store or RuStore, your licence to that version is also governed by that store's terms, such as the Steam Subscriber Agreement, the Epic Games Store End User License Agreement, the Google Play Terms of Service, Apple's Licensed Application End User License Agreement, or RuStore's user terms. Where the store's terms and these terms differ for that version, the store's terms apply.

For versions from the Apple App Store: this agreement is between you and Digitalis LLC, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is a third-party beneficiary of these terms with the right to enforce them against you.

4. What is not allowed

You may not:

• copy, sell, rent, sublicense or redistribute our games or their files, except as the law allows;
• decompile or reverse-engineer them, except where the law gives you that right;
• remove or change copyright notices or other notices;
• attack, overload or try to gain unauthorised access to our website or servers;
• use the Services to break the law or harm anyone.

5. Videos and streams

You are welcome to stream our games and to publish videos and screenshots of them, including on monetised channels, as long as you do not suggest that we made or endorse your content, and you do not share our game files themselves.

6. Ownership

The Services and everything in them, including code, art, music, text and names, belong to Digitalis LLC or its licensors and are protected by copyright and other laws. These terms do not transfer any ownership to you. If you send us ideas or feedback, we may use them freely and without obligation to you.

7. Purchases and refunds

Purchases made through a store are processed by that store, and refunds follow its policy. See Purchases and refunds for where to ask. Nothing in these terms limits any refund or other right you have under consumer law.

8. Changes to our games

Our games are in active development. We may update, change, suspend or stop any part of the Services, including demos and test builds, at any time. Where you have paid for a version through a store, the store's terms and your consumer rights still apply.

9. Disclaimer

To the extent the law allows, the Services are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not promise that the Services will be uninterrupted or free of errors.

10. Liability

To the extent the law allows, Digitalis LLC is not liable for indirect, incidental, special or consequential losses, or for loss of data, profits or goodwill, arising from the Services. Our total liability for any claim is limited to the greater of the amount you paid for the product concerned in the twelve months before the claim and 50 US dollars.

Some places do not allow these limits. Nothing in these terms excludes liability that cannot be excluded by law, or takes away rights you have as a consumer where you live.

11. Governing law

These terms are governed by the laws of the jurisdiction in which Digitalis LLC is organised, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts.

12. Changes to these terms

We may update these terms. When we do, we will change the date at the top of this page; significant changes will also be noted here. Continuing to use the Services after a change means you accept the updated terms.
